Terms of Service

1. Overview

Choosy is a technology platform owned and operated by Choosy LLC that helps home sellers explore real estate services and connect with licensed real estate professionals. Except where Choosy LLC is separately acting as a licensed brokerage pursuant to state law, the platform itself is not intended to provide legal advice, tax advice, or other professional services.

2. Eligibility

Users must be at least eighteen (18) years old and legally capable of entering into binding contracts.

3. Services

The platform may provide intake forms, educational resources, communication tools, scheduling tools, document storage, analytics, and introductions to participating real estate professionals and service providers.

4. Accounts

Users are responsible for maintaining the confidentiality of login credentials and for all activities occurring under their account.

5. Fees and Payment

Fees, commissions, referral fees, and pricing models will be disclosed before services are rendered. Certain services may be paid at closing and may be subject to separate agreements.

6. Real Estate Relationships

A real estate agency relationship exists only when established by a separate written agreement with a licensed brokerage. Use of the platform alone does not create agency representation.

7. User Content

Users retain ownership of information they upload but grant Choosy a limited license to use such information to provide and improve services.

8. Acceptable Use

Users may not upload unlawful content, interfere with platform security, attempt unauthorized access, misrepresent information, or use the platform to violate applicable law.

9. Intellectual Property

The platform, software, branding, forms, workflows, graphics, and content are owned by Choosy LLC or its licensors and are protected by applicable intellectual property laws.

10. Privacy

Use of the platform is also governed by the Choosy Privacy Policy.

11. Third-Party Services

Choosy may integrate with third-party software providers and service partners. Choosy is not responsible for third-party products or services.

12. Disclaimers

The platform is provided "as is" and "as available" to the maximum extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law, Choosy LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the platform.

14. Indemnification

Users agree to defend, indemnify, and hold harmless Choosy LLC and its affiliates from claims arising from user conduct, uploaded content, or violations of law.

15. Suspension and Termination

Choosy may suspend or terminate access for violations of these Terms, security concerns, fraudulent activity, or other lawful reasons.

16. Electronic Communications

Users consent to receive communications electronically, including notices, disclosures, and agreements.

17. Governing Law

These Terms shall be governed by the laws of the State of Missouri, without regard to conflict of law principles.

18. Dispute Resolution

The parties will first attempt to resolve disputes informally. The parties may mutually agree to mediation or arbitration.

19. Changes to Terms

Choosy may update these Terms from time to time. Material changes will be communicated through reasonable notice methods.
